1. Parties & Purpose
This Vehicle Rental Agreement & Liability Waiver ("Agreement") is entered into between JeepCation PR LLC, a Puerto Rico limited liability company ("Lessor"), and the Renter identified in this reservation ("Renter"). By signing this Agreement electronically, Renter confirms they have read, understood, and accepted all provisions herein. This Agreement is binding upon execution and governs the entire rental relationship.
2. Eligibility & Driver Requirements
Renter must be at least 18 years of age and hold a valid, non-expired driver's license (U.S., Puerto Rico-issued, or internationally recognized). Renters ages 18β24 are subject to a mandatory Young Driver Surcharge of $15.00 per day and assume full personal liability for any incidents during the rental period. Drivers age 25 and older are not subject to the Young Driver Surcharge. Only the Renter and drivers explicitly listed and pre-approved in writing by Lessor are authorized to operate the vehicle. Any unauthorized driver immediately voids all protections and renders the Renter solely and personally liable for all damages, fines, incidents, and associated costs.
3. Rental Charges & Authorization
Renter agrees to pay all charges stated in the reservation confirmation, including the applicable daily rate, fees, taxes, and any selected add-ons. A flat $50.00 One-Day Reservation Fee shall be applied to ALL single-day (1-day) rentals, in addition to the daily rate. This One-Day Reservation Fee is included in the full refund when a reservation is cancelled more than 2 hours before scheduled pickup. Renter hereby irrevocably authorizes Lessor to charge the credit or debit card on file β or any other payment method provided β for any and all additional amounts owed following vehicle return, including but not limited to: physical damage, fuel deficiency, tolls, administrative fees, parking or traffic fines, excessive cleaning, loss of use during repairs, and any other fees arising under this Agreement.
4. Insurance & Liability Disclaimer
CRITICAL NOTICE: Lessor provides ONLY the mandatory Compulsory Liability Insurance ("ACAA") required by Puerto Rico law (Act No. 253 of 1995). This statutory coverage applies exclusively to third-party bodily injury and property damage claims and does NOT protect the Renter against financial liability for: (a) physical damage to the rental vehicle; (b) theft or vandalism; (c) rollover or single-vehicle accidents; (d) damage caused by negligence, reckless operation, or prohibited use. Renter assumes FULL and UNLIMITED financial responsibility for any loss, damage, or liability not covered. Renter is strongly advised to verify personal auto insurance or credit card coverage prior to the rental.
5. Vehicle Condition & Digital Inspection
Renter accepts the vehicle in its documented condition as captured in the mandatory pre-rental digital photo inspection. Renter agrees to review all inspection photos at pickup and immediately report any discrepancies in writing via WhatsApp or email before driving away. Any damage not documented at pickup automatically becomes the Renter's financial responsibility. Renter is required to complete a digital photo inspection at both pickup and return. Failure to complete the return inspection does not release Renter from liability for damage discovered post-return.
6. Self-Service Rental Operations
Renter acknowledges that JeepCation PR operates a technology-enabled self-service rental model. Vehicle access is provided via a secure lockbox code, digital key system, or staff-assisted handoff as communicated prior to pickup. Renter accepts sole responsibility for correctly operating all vehicle mechanical systems; properly securing doors, roof panels, windows, and soft-top components; and reporting any operational issues or malfunctions immediately to Lessor via WhatsApp at (939) 903-3429.
7. Lockbox, Key & Access Device Responsibility
Renter assumes full financial responsibility for the lockbox, key fob, transponder, and any other access devices provided from the moment of pickup until return is confirmed by Lessor. Charges for loss or damage include: replacement key fob ($350β$700 depending on vehicle); lockbox replacement ($150); emergency locksmith or dealer fees (actual cost); and any towing or recovery expenses resulting from key loss.
8. GPS Telematics & Real-Time Monitoring
Renter expressly consents to continuous GPS monitoring of vehicle location, speed, heading, idle time, hard braking events, rapid acceleration, and all other telematic data throughout the rental period. Renter acknowledges that: (a) monitoring is active 24 hours a day; (b) data is stored and may be reviewed at any time; (c) telematics data constitutes binding evidence of vehicle operation and compliance; (d) violations detected via telematics may result in immediate deposit forfeiture and vehicle recovery without prior notice.
9. Incidental Hold β Authorization
A $150.00 refundable authorization hold ("Incidental Hold") will be placed on Renter's credit or debit card at or before vehicle pickup. This is a temporary hold, not a charge, intended to cover potential incidental damages, fees, or violations. No reservation deposit is required to make a reservation. The hold will be released within 3β7 business days following satisfactory vehicle return, subject to: completion of the return inspection; no outstanding damage claims; no unresolved toll, fine, or fee balances; and full fuel level compliance. Lessor reserves the right to convert the hold to a charge or initiate additional charges if any conditions are not met.
10. Tolls, Violations & Administrative Fees
Renter is solely responsible for all AutoExpreso electronic toll charges, parking citations, traffic violations, red-light camera fines, and any government-imposed fines or penalties incurred during the rental period. Post-return administrative processing fees apply as follows: $10.00 per toll event processed by Lessor; $25.00 per traffic or parking violation processed by Lessor; $50.00 flat administrative fee for any violation requiring Lessor correspondence with government agencies.
11. Fuel Policy
Vehicle must be returned with the same fuel level recorded at pickup, as documented in the pre-rental inspection. If returned below the documented fuel level: Renter will be charged $6.00 per gallon for fuel required to restore the level, plus a $15.00 fuel service processing fee. Renter may not prepay for fuel.
12. Cleaning & Vehicle Condition Standards
Vehicle must be returned in a reasonably clean condition consistent with normal use. Excessive cleaning fees will be assessed as follows: standard excess dirt or sand: $75β$150; pet hair or unauthorized pet transport: $150β$300; food or beverage contamination: $100β$250; smoking, vaping, or marijuana use inside the vehicle: $250 minimum; biological contamination or hazardous material exposure: $500 minimum plus professional remediation costs.
13. Accidents, Theft & Damage Reporting
In the event of any accident, collision, theft, vandalism, or damage β regardless of fault or severity β Renter must: (1) immediately contact local law enforcement (911) and obtain a police report; (2) notify Lessor within one (1) hour via WhatsApp at (939) 903-3429; (3) not move the vehicle until authorized by law enforcement; (4) obtain all third-party information; (5) not admit fault or liability. Failure to follow this protocol may void insurance protections and increase Renter's personal financial liability.
14. Prohibited Uses & Violations
Strictly prohibited: operating off-road or on unpaved, gravel, or flooded roads; towing or pushing other vehicles; transporting the vehicle outside Puerto Rico without written consent; operating under the influence; participation in racing or speed events; permitting unauthorized drivers; transporting hazardous or illegal materials; use in illegal activity; tampering with the vehicle, GPS, or telematics equipment. Violation results in: immediate forfeiture of all deposits; immediate vehicle recovery; full personal liability for all costs; and potential criminal referral.
15. Jeep Wrangler & Convertible Vehicle Acknowledgement
Renter acknowledges: (a) the Jeep Wrangler has a higher center of gravity and elevated rollover risk, particularly during sharp turns; (b) Renter has been made aware of and accepts this increased risk; (c) improper removal, installation, or securing of doors, roof panels, windows, or soft-top components is Renter's SOLE financial responsibility, including any resulting weather damage; (d) water damage caused by an improperly closed or secured roof or windows is NOT covered by any insurance and is Renter's full financial liability.
16. Unlimited Mileage
Unlimited mileage is included in every reservation within Puerto Rico. The vehicle must remain on the island of Puerto Rico at all times. Transporting the vehicle by ferry to Vieques, Culebra, or any other island is prohibited.
17. Cancellation & No-Show Policy
Cancellation requests may be submitted by WhatsApp at (939) 903-3429 or by email to Christian@luxewildpr.com. Cancellation more than 2 hours before scheduled pickup: Full refund of any amount paid toward the reservation, including any One-Day Reservation Fee paid. Cancellation within 2 hours of scheduled pickup: No refund. No-show (failure to pick up without prior cancellation): No refund. No reservation deposit is required to make a reservation. Lessor will issue a full refund if cancellation is caused by vehicle unavailability beyond Lessor's control.
18. Vehicle Recovery & Remote Immobilization
Lessor reserves the right, without prior notice, to remotely locate, track, immobilize, and/or physically recover the vehicle at Renter's expense if: (a) the rental period has expired; (b) Renter has materially breached this Agreement; (c) Renter is unreachable for more than 4 consecutive hours; (d) the vehicle is reported stolen or involved in a criminal matter; (e) Renter has engaged in prohibited use; (f) Lessor has reasonable cause to believe the vehicle is at risk. All recovery costs are charged to Renter.
19. Electronic Communications & Evidence Consent
Renter consents to the use of the following as legally admissible evidence in any dispute, insurance claim, arbitration, or legal proceeding: GPS and telematics data; digital inspection photographs and videos; electronic signatures and signed agreement records; WhatsApp, SMS, and email communications; payment records; and surveillance footage at any pickup or return location. Renter waives any objection to admissibility of such electronic evidence.
20. Chargeback & Dispute Resolution Policy
Renter agrees to contact JeepCation PR first at Christian@luxewildpr.com or (939) 903-3429 to attempt good-faith resolution of any billing dispute before initiating a chargeback. In the event of an unwarranted chargeback, Renter: (a) authorizes Lessor to provide this signed Agreement and all records to the card network as evidence; (b) agrees to reimburse Lessor for all chargeback fees and legal costs; (c) acknowledges that filing a false chargeback may constitute fraud.
21. Force Majeure
Lessor shall not be liable for any failure to perform caused by events beyond its reasonable control, including natural disasters, hurricanes, earthquakes, floods, pandemics, government-mandated shutdowns, civil unrest, or acts of war. Lessor will make commercially reasonable efforts to notify Renter and arrange an alternative or issue a credit or refund as appropriate.
22. Release, Waiver & Indemnification
TO THE FULLEST EXTENT PERMITTED BY LAW: Renter hereby releases, waives, discharges, and covenants not to sue JeepCation PR LLC, its members, managers, officers, employees, and agents from any and all liability, claims, losses, or damages β whether known or unknown β arising from the rental, operation, or return of the vehicle, including personal injury, property damage, or death, EXCEPT in cases of Lessor's proven gross negligence or intentional willful misconduct. Renter agrees to indemnify and hold harmless Lessor from all third-party claims, lawsuits, costs, and attorney's fees arising from Renter's use of the vehicle.
23. Limitation of Liability
In no event shall Lessor's total liability to Renter exceed the total rental charges actually paid by Renter for the specific rental period giving rise to the claim. Lessor shall not be liable for any indirect, incidental, consequential, punitive, or special damages of any kind, including loss of profits, loss of use, or emotional distress.
24. Governing Law & Arbitration
This Agreement is governed exclusively by the laws of the Commonwealth of Puerto Rico. Any dispute arising out of or relating to this Agreement shall be resolved by binding arbitration administered in San Juan, Puerto Rico, in accordance with the rules of the American Arbitration Association (AAA). The arbitrator's decision shall be final and binding. Renter waives the right to participate in any class action lawsuit or class-wide arbitration.
25. Severability
If any provision of this Agreement is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
26. Entire Agreement & Amendment
This Agreement constitutes the entire agreement between the parties and supersedes all prior representations, warranties, understandings, and agreements β whether oral or written. No modification shall be binding unless made in writing and duly signed by an authorized representative of JeepCation PR LLC and by the Renter. Electronic acceptance constitutes a valid and binding signature for all purposes.
27. Rate & Promotion Policy
Rates and promotions are subject to change. Once a reservation is confirmed, the rate and promotional terms in effect at the time of booking are locked in for that reservation. Future rate changes or promotions do not apply retroactively.
